Il provvedimento ha definito un giudizio in tema di recesso dal rapporto di comodato di un appartamento, che presentava una relazione con altro giudizio int tema di affidamento del figlio minore.
La parte assistita dallo Studio, genitore di un minore, si opponeva alla domanda di accertamento dell’efficacia del recesso dal comodato, comunicato dal comodante, proprietario dell’immobile, al contempo genitore dell’altro genitore del minore. La principale argomentazione dedotta consisteva nella permanente esigenza abitativa del minore, che costituiva la specifica funzione del comodato a suo tempo intercorso tra i genitori del minore ed il proprietario stesso, prima che le convivenza tra i due genitori fosse interrotta.
La controversia è stata definita con un accordo, che ha portato all’accoglimento di condizioni concordate dalle parti, che prevedono la cessazione della materia del contendere a fronte dell’intervenuta assegnazione della casa familiare disposta nel giudizio intercorso tra i genitori del minore.
Il Tribunale ha recepito l’accordo raggiunto dalle parti del giudizio.

The ruling resolved a case concerning the termination of a free loan agreement of a flat, which was related to another case concerning the custody of a minor child.
The party assisted by the Law Firm, the parent of a minor, opposed the request to declare the effectiveness of the termination of the loan agreement, communicated by the lender, the owner of the property, and also the parent of the minor’s other parent. The main argument advanced was the minor’s permanent need for housing, which constituted the specific purpose of the loan agreement between the minor’s parents and the owner, before the parents’ cohabitation was terminated.
The dispute was resolved with an agreement, which led to the acceptance of conditions agreed upon by the parties, which provide for the cessation of the dispute upon the assignment of the family home as ordered in the proceedings between the minor’s parents.
The Court upheld the agreement reached by the parties.
