Il provvedimento si è pronunciato sulla richiesta di rimpatrio di un minore in conformità alla Convenzione dell’Aia del 1980 sugli aspetti civili della sottrazione internazionale di minori.
La parte assistita dallo Studio, genitore di un minore, ha esperito la procedura prevista dall’art. 4 L. 15 gennaio 1994, n. 64, chiedendo il rimpatrio del minore, sottratto da uno Stato dell’Unione Europea, membro della Convenzione, costituendosi nel giudizio iniziato dal P.M. dopo l’impulso dell’Autorità Centrale straniera. La stessa parte ha contestato le eccezioni avversarie, nell’ambito di un’istruttoria avente ad oggetto la determinazione della residenza del minore (con l’utilizzo dei parametri tipici: scuola, attività sportive, medico di famiglia, vaccinazioni) e l’assenza di pericolo per la sua persona all’esito del rimpatrio.
Il Tribunale, accertata la residenza abituale del minore nello Stato richiedente, ha disposto il rimpatrio del minore, immediatamente adempiuto.

The ruling addressed a request for the repatriation of a minor in accordance with the 1980 Hague Convention on the Civil Aspects of International Child Abduction.
The party assisted by the firm, the parent of a minor, initiated the procedure provided for by Article 4 of Law No. 64 of January 15, 1994, requesting the repatriation of the minor, abducted from a European Union member state of the Convention, by appearing in the proceedings initiated by the Public Prosecutor pursuanto the request of the foreign Central Authority. The same party contested the counterpart’s objections during an investigation aimed at determining the minor’s residence (using typical criteria: school, sports activities, family physician, vaccinations) and the absence of danger to his or her person following repatriation.
The Court, having ascertained the minor’s habitual residence in the requesting state, ordered the minor’s repatriation, which was immediately fulfilled.
